On March 8, 2026 at approximately 3:41 A.M., an officer with the Dayton Police Department was on routine patrol in the area of County Road 81 near Brockton Lane in Dayton, Hennepin County, Minnesota when the officer observed a vehicle with expired registration. The registration had expired well over a year prior. The officer conducted a traffic stop and identified the driver as JORGE ARMANDO CHAVEZ LAZARIN, [DOB REDACTED], DEFENDANT. While speaking with Defendant the officer observed Defendant had bloodshot watery eyes, thick slurred speech, and smelled of a consumed alcoholic beverage.
The officer also observed an open bottle of Corona beer on the back floorboard. When asked, Defendant told the officer he had consumed 6-7 beers approximately three hours ago. The officer had Defendant complete field sobriety tests and observed numerous signs of impairment including lack of smooth pursuit in both eyes, an improper turn, swaying while balancing, putting his foot down, and using his arms to balance. The officer then administered a PBT which showed an alcohol concentration of 0.12. Defendant was arrested and officers searched the vehicle.
The vehicle was not equipped with ignition interlock. Inside the vehicle officers found several partially consumed Corona beer bottles in the front passenger door panel, the rear floorboard, and the front passenger seat pocket. Officers also found a glass pipe on the driver’s floorboard and a small plastic baggie containing a white powder substance in the driver’s side upper door pocket. Defendant was read the breath test advisory after which Defendant gave a breath sample with a final result of 0.12 at approximately 4:53 A.M. The white substance field-tested positive for methamphetamine and weighed 0.90 with packaging.
In a post-Miranda statement Defendant told an officer he is the only person who drives the vehicle and he was the only person in the driver’s seat today. The glass pipe is his and he uses it to smoke methamphetamine which he smoked tonight. Defendant claimed the white powdery substance is not his and looks like cocaine. A review of Defendant’s driving record reveals his driving privileges are revoked, he is required to drive with ignition interlock installed, and he has the following prior convictions: 1. DWI - over 0.08 - convicted January 24, 2005 in ••-CR-••-•••• 5. DWI - over 0.08 - convicted June 2, 2004 in ••-CR-••-•••• Defendant is in custody at the Hennepin County Jail.
