The passenger who exitted was identified identified as one of the assailants from the incident prior to the carjacking. The juvenile male went into the store and and zipped up his hoodie over the lower portion of his face. Defendant, while in the store, had a cart of merchandise. It appeared that the juvenile saw Defendant and Defendant saw him. The juvenile began running out of the store and Defendant ran after. Once outside Defendant ran straight to his car parked in the fire lane. Defendant's brothers gave chase as well.
The Mazda SUV pulled up to the front of the store at a high rate of speed. While in the Malibu Defendant drove up to the Mazda and slowed down. The video captured two apparent muzzle flashes coming from the driver's door area of Defendant's vehicle. The muzzle flash was also consistent with the trajectory of one confirmed bullet strike (the inside wall of the front passenger side tire of the Mazda SUV) and a suspected bullet strike (on the side of Wal-Mart approximately 10 yards to the west of the grocery exit sliding doors). While investigating both incidents, officers observed the suspect blue Malibu outside a residence affiliated with Defendant.
Defendant was convicted of 3rd Degree Assault in 55-CR-18-7100. Defendant is pending sentencing for a 2nd Degree Assault in 55-CR-24-2085. Given Defendant's serious violent history and the seriousness of this offense, the State finds Defendant to be an ongoing danger to public safety. Moreover, law enforcement has been attempting to locate Defendant, but are unable to find him. Defendant is likely in hiding. In addition, Defendant is on warrant status in 19HA-CR-25-2103. Given all this, the State is requesting a Complaint Warrant.
PLEASE TAKE NOTICE: YOU MUST APPEAR FOR EVERY COURT HEARING REGARDING THIS CASE. FAILURE TO APPEAR FOR COURT IS A CRIMINAL OFFENSE AND MAY RESULT IN ADDITIONAL CRIMINAL CHARGES BEING IMPOSED AND PUNISHED AS PROVIDED IN MINNESOTA STATUTES SECTION 609.49.
