On or about November 1, 2025, at approximately 10:35 PM, Officer Johnson of the Woodbury Department of Public Safety observed a vehicle traveling on the roadway without headlints illuminated while in the area of Spring Hill Drive and City Place Loop in the City of Woodbury, Washington County, Minnesota. The driver of the motor vehicle was later fully identified as ZOE MARIE GEHRING, [DOB REDACTED], Defendant herein. The officer approached and observed an infant in a rear-facing car seat directly behind the driver.
The officer immediately smelled a strong odor of alcohol emitting from the vehicle. Defendant was observed to have bloodshot and watery eyes. Defendant stated she had been crying and had just left an argument. The officer believed Defendant to be under the influence of alcohol and requested a second officer to conduct sobriety tests. The second officer observed Defendant's eyes to be glossy and also smelled a strong odor of alcoholic beverage. Defendant admitted to having consumed two alcoholic beverages but indicated it had been earlier that evening, with her last about 4 or 5 hours prior to the stop.
The officer administered standardized field sobriety tests, during which Defendant performed poorly and several clues of impairment were observed. Defendant provided a breath sample for a preliminary breath test, the results of which indicated she had a 0.124 BAC. Defendant was placed under arrest and a sober adult was contacted to pick up Defendant's infant child. Defendant was then transported to Woodbury Police Department. Defendant was read the Minnesota Breath Test Advisory and was provided an opportunity to contact an attorney.
Defendant subsequently agreed to submit to an evidentiary breath test. Defendant was administered a Data Master Transportable (DMT) breath test at approximately 12:15 AM, the final reading of which indicated Defendant had a 0.10 BAC. A review of Defendant's records shows no prior qualifying impaired driving related convictions.
