On January 10, 2026, Officer Hershberger and Officer Rodenwald of the Rochester Police Department were on active patrol, heading southbound on Broadway Ave S and 4th St in Rochester, Minnesota. At approximately 10:50 P.M., a vehicle stopped next to Officer Hershberger and Officer Rodenwald's unmarked squad at a red light. Officer Hershberger recognized the driver of the vehicle as Luis Hernandez- Aguilar from prior contacts. Hernandez-Aguilar was previously stopped by law enforcement in ICR 25- 65290 for driving with a revoked license.
Officer Hershberger confirmed through DVS that Hernandez- Aguilar's license was still revoked. When the light turned green, Officer Rodenwald pursued Hernandez- Aguilar who made a U-turn around the 700 block of Broadway Ave S and increased speed. Officer Rodenwald activated his emergency lights and continued to pursue. Hernandez-Aguilar then turned eastbound on 4th St SE from Broadway Ave S. Hernandez-Aguilar was near the intersection of 4th St and 3rd Ave SE when officers turned onto 4th St from Broadway.
Hernandez-Aguilar had gained three city blocks on law enforcement and it took him approximately 27 seconds to get from the 700 block of Broadway ave S to the intersection of 4th St and 3rd Ave SE. Based on Hernandez-Aguilar excessive speed, law enforcement made the decision to no longer pursue. Officers then drove to [ADDRESS REDACTED] SE which was Hernandez-Aguilar's listed address. Upon arrival, officers located the suspect vehicle which was still running. Using the squad's PA system, Officer Hershberger called Hernandez-Aguilar out by name and informed him that he was under arrest.
Shortly after Officer Hershberger made his announcement, the lights inside the trailer shut off and there was no more movement. Law enforcement elected to walk away from the trailer and obtained surveillance footage from city cameras which captured Hernandez-Aguilar fleeing from law enforcement. On January 12, 2026, at approximately 6:32 P.M., Officer Hershberger located the suspect vehicle at 115 16th Ave NW in Rochester, Minnesota. Officer Hershberger walked over to a restaurant at 24 17th Ave NW and spoke to the manager who said Luis Hernandez-Aguilar worked at the restaurant.
Officer Hershberger saw Luis Hernandez-Aguilar standing in the kitchen and placed him under arrest. Hernandez-Aguilar was given a Miranda warning in english and spanish and gave a voluntary statement. Hernandez-Aguilar admitted he fled from law enforcement because he thought they were Immigration and Customs Enforcement (ICE) agents. Hernandez-Aguilar was subsequently transported to the Olmsted County Adult Detention Center (ADC). PLEASE TAKE NOTICE: YOU MUST APPEAR FOR EVERY COURT HEARING REGARDING THIS CASE.
