Your complainant states that on September 10, 2025, at approximately 9:38 P.M., while conducting stationary patrol on Vine Hill Road in the City of Shorewood, Hennepin County, Minnesota, Officer Nelson observed a Mercedes G30 bearing Minnesota license plate number ZFE539 traveling northbound at what appeared to be a high rate of speed. Officer Nelson activated his front racing radar and received a reading of 41 miles‐per‐hour in a 30 mile‐per‐hour zone. Officer Nelson initiated a traffic stop of the vehicle and made contact with its driver, who was identified by Florida driver’s license as JEFFREY DAVID THOELE, [DOB REDACTED], the defendant herein.
Officer Nelson explained the reason for the stop to the defendant, who stated that they were on their way home from the airport. While speaking with the defendant, Officer Nelson detected the odor of an alcoholic beverage emanating from the vehicle and observed that his eyes were bloodshot and watery. The defendant admitted consuming one beer at approximately 6:30 P.M. The defendant was unable to successfully perform field sobriety tests as requested by Officer Nelson. A PBT was administered and registered a reading of.071. Based upon his observations, Officer Nelson formed the opinion that the defendant was driving while under the influence of multiple substances, and placed him under arrest.
During a search of the defendant’s person, Officer Nelson located a vape device with a cartridge in his pocket. The defendant stated that the vape contained THC. Your complainant transported the defendant to the South Lake Minnetonka Police Department where he was read the Minnesota Breath Test Advisory. The defendant elected to submit a sample of his breath for testing, the result of which indicated an alcohol concentration of.06 at 10:22 P.M. Your complainant transported the defendant to West Health, where a sample of his blood was drawn pursuant to a search warrant and submitted for analysis, the result of which revealed 21.3 ng/ml of delta-9- tetrahydrocannabinol (delta-9-THC), a Schedule III controlled substance, 17.4 ng/ml of 11-hydroxy-delta-9- tetrahydrocannabinol (hydroxy-THC), a Schedule III controlled substance, and 139 ng/ml of 11-nor-9-carboxy- delta-9-tetrahydrocannabinol (carboxy-THC), an inactive metabolite of delta-9-THC, a Schedule III controlled substance.
