Peter Police Department. On September 29, 2025, at approximately 12:25 P.M., Nicollet County Dispatch reported a driving complaint regarding a a white Ford F-150 traveling north on US Highway 169 from Seven Mile Creek Park. The complaintant stated that the F-150 had pulled out in front of him from the east side of Seven Mile Creek turn causing him to have to slam on his brakses. The F-150 then swerved onto the right-side shoulder side swiping the guard rail. The Complainant followed the F-150 to Saint Peter until it was stopped by police, observing it swerve over the fog and center lines of the road.
OFFICER WILLIAM REINBOLD located the vehicle traveling northbound on South Front Street, in the City of St. Peter, County of Nicollet, State of Minnesota. OFFICER REINBOLD observed the vehicle veer to the right side of the road into the marked off parking lane then swerve back to the center of the roadway, then veer towards the pylons marking the beginning of the street parking area at the intersection of Walnut Street, almost colliding with the pylons before swerving back to the center of the roadway.
OFFICER REINBOLD activated his emergency lights to conduct a traffic stop. The vehicle slowed and made a wide turn into the oncoming traffic lane of Mulberry Street. The vehicle came to a dead end at Mulberry Street, stopped, and then started to move forward again. OFFICER REINBOLD exited his vehicle and yelled at the driver before the vehicle came to a complete stop. As OFFICER REINBOLD approached the vehicle, he could smell the scent of alcoholic beverage coming from the vehicle. OFFICER REINBOLD observed the front seat passenger to be holding a 10-month-old female on her lap and not in a car seat.
OFFICER REINBOLD saw several empty Modelo beer cans on the floor of the passenger side. OFFICER REINBOLD observed the driver to be swaying while sitting in his seat and that his eyes were bloodshot and watery. FRANCISCO HERNANDEZ CASTRO, [DOB REDACTED], identified by a Guatemalan ID, the DEFENDANT herein, was the driver. When asked, DEFENDANT stated that he had consumed two of the several empty beer cans in the vehicle. When asked to exit the vehicle, DEFENDANT had trouble balancing and was swaying very noticeably.
OFFICER REINBOLD could not administer the Horizontal Gaze Nystagmus test because DEFENDANT was swaying back and forth, had head nods, and did not keep his eyes open. Due to DEFENDANT’S balancing issues and for his own safety, OFICER REINBOLD decided to forgo the Walk and Turn Test and One Leg Stand Test. A Preliminary Breath Test was administered which resulted in a.24 BAC. OFFICER REINBOLD placed DEFENDANT under arrest for Driving While Intoxicated and transported him to the Nicollet County Jail.
Using the Language Line, OFFICER REINBOLD read the Breath Test Advisory and the DEFENDANT agreed to give a breath test with DataMaster. After multiple failed attempts, OFFICER REINBOLD asked DEFENDANT if he would rather have a blood test, which DEFENDANT stated, “whatever you would like.” OFFICER REINBOLD applied for, and obtained a search warrant for a blood draw. DEFENDANT was transported to River's Edge Hospital. DEFENDANT passed out during the ride to River's Edge, and was wheeled into the ER by wheelchair as he was having considerable trouble walking.
