Upon arrival to the residence, Officer West spoke to the reporting party, who stated that RUBY MARIE BELLAND [DOB REDACTED] had been at her home and she wanted her trespassed. Officer West then attempted to find BELLAND. Officer West did eventually locate BELLAND at the Roundhouse in White Earth, sitting in the driver’s seat of a red in color Chrysler 200. Officer West spoke to BELLAND to inform her of the trespass. While speaking to BELLAND, Officer West could smell the odor of alcohol coming from her person.
Officer West also observed BELLAND to have watery eyes and a slurred speech pattern. Officer West warned BELLAND to not drive and then left, parking his patrol vehicle at the intersection of County Road 21 and Eagle Road, in Becker County, Minnesota. At approximately 8:54 PM, Officer West observed the red in color Chrysler 200 leave the Roundhouse and drive on Marten Drive. Officer West followed the vehicle and observed the license plate match the license plate that he had observed earlier. The vehicle failed to signal its right hand turn onto Loon Drive.
Officer West activated his emergency lights and conducted a traffic stop on the vehicle. As Officer West approached the vehicle, he observed BELLAND in the driver’s seat. Officer West again smelled the odor of alcohol coming from BELLAND’s person, that BELLAND’s eyes were watery, and that she had a slurred speech pattern. When asked if she had been drinking, BELLAND responded “yeah.” Officer West had BELLAND perform field sobriety tests and observed multiple indicia of intoxication. BELLAND was placed under arrest and transported to the Becker County Jail.
During transport to the jail, Officer West observed BELLAND to be using a cell phone. Officer West attempted to retrieve the cell phone from BELLAND, but she placed it into her bra and refused to provide it to Officer West. Officer West continued BELLAND’s transport to the jail, but then observed BELLAND appearing to be trying to light something on fire in the backseat of the patrol vehicle. Officer West then pulled over and removed BELLAND from the patrol vehicle and switched her handcuffs to the back of her person.
Upon arriving at the Becker County Jail at 9:34 PM, Officer West read BELLAND the breath test advisory. BELLAND stated that she understood what was explained. When asked if she would take the breath test, BELLAND stated “f*** no.” BELLAND has the following prior impaired driving conviction within the last ten years: a conviction for DWI in violation of Minn. Stat. 169A.20 subd. 1(1) on December 18, 2023 in ••-CR-••-••••. PLEASE TAKE NOTICE: Pursuant to Minn.
