The caller, KANE, said his firearm accidentally went off and the round had gone through his kitchen window. Upon police arrival, several people were on the porch at 402 Hope saying someone shot through their vehicle window. Police spoke to SH and AR who said they were in the vehicle in the driveway talking and listening to music when a round came through the passenger window causing glass to fly. The two crawled out of the vehicle, ran to 402 Hope, and called 911. Police saw a bullet hole in the vehicle’s passenger window and a bullet hole in the rear upstairs window of 396 Hope.
Police found KANE standing in the doorway of 396 Hope with his hands up. KANE said his gun accidentally went off. With permission, police retrieved his black Springfield XP 9mm handgun. The slide was open and locked and the chamber was empty. The loaded magazine had been removed and was next to the handgun. In the upper unit at 396, police saw a bullet hole in the kitchen window that appeared to have a downward angle trajectory towards the vehicle in the driveway at 402 Hope. In the kitchen, police also saw a spent 9mm casing on the floor.
KANE was arrested. En route to the LEC KANE said he was a three-gun competitive shooter who had placed in the top ten multiple times. He said now his life was over due to an accident. Pursuant to a search warrant, police recovered two long guns and a significant quantity of ammunition from the upper unit at 396 Hope. In post-Miranda statements, KANE said he had been having an on-going dispute with the neighbors at 402 Hope and they recently made many statements that caused him to be afraid for his life.
