That on or about October 4, 2025, at approximately 20:09 hours, Minneapolis Police Officers and Minnesota State Patrol Troopers responded to a property damage accident at 3511 11th Ave. S., in the City of Minneapolis, Hennepin County, Minnesota. Officer B. K. Spoke with M. J. L., the registered owner of one of the involved vehicles (MN #HGV151, Chevrolet Captiva) and Victim 1 herein, who stated that she was parked on the street in front of the above address, when her vehicle was struck by another vehicle, later identified as a Dodge Journey (MN #LDW399) and driven by a person later identified as BALDEMAR PEREZ MENCHO, [DOB REDACTED], Defendant herein.
Victim 1, who was a passenger in her vehicle, stated that Defendant continued forward, hitting another vehicle (later identified as MN #RRV122, Toyota Rav 4), and coming to a complete stop in the middle of the road. Victim 1 said Defendant then exited the car, returned inside, and attempted to leave but their vehicle did not start. The officer also spoke with D. R. H., the driver of the Victim 1’s vehicle, who also reported seeing the vehicle (MN #LDW 399) strike both vehicles. Finally, Officer B. K. Spoke to A. B. S., the registered owner of the Rav 4 and Victim 2 herein, who was in his apartment and did not see the accident; Victim 2 heard the crash.
Trooper M. S. Responded to the scene and observed the 3 involved vehicles. Defendant was already inside an ambulance and complaining of stomach pains. The trooper contacted Defendant inside the ambulance and while next to Defendant he smelled a distinct and strong odor of consumed alcoholic beverage. Defendant looked directly at Trooper M. S. And the trooper noticed that Defendant’s eyes were glossy and bloodshot. The trooper asked Defendant how much alcohol he had consumed, and Defendant hesitated to answer but then said in Spanish, no more than two.
Because Defendant was laying on a stretcher and complaining of stomach pains, Trooper M. S. Did not perform any Standardized Field Sobriety Tests (SFST) on Defendant; the trooper was able to administer a Preliminary Breath Test (PBT) on Defendant, revealing a breath alcohol concentration of.166. Defendant was transported to Hennepin County Medical Center (HCMC) and Trooper M. S. Followed. While at HCMC, Trooper M. S. Drafted a search warrant for Defendant’s blood or urine sample, which was signed by Hennepin County Judge Melissa Houghtaling.
With the assistance of a Spanish language line interpreter, Trooper M. S. Informed Defendant he had obtained a search warrant for his blood or urine and that refusal to comply would be a crime; Defendant agreed to submit a blood sample. Pursuant to the warrant, a blood test was performed on Defendant at 21:50 hours, by a registered nurse, which was later analyzed by the Minnesota BCA to reveal an alcohol concentration of.15 grams per 100 milliliters of blood. Defendant does not have a valid Minnesota Driver’s License.
