M., Deputy Nicholas Lindberg, of the Sherburne County Sheriff's Office, was parked at a local gas station located on the 700 block of 15th Avenue Southeast, in the city of Saint Cloud, Sherburne County, Minnesota, when he saw two males walk in and out of the gas station multiple times. The males were going out to a vehicle with Minnesota license plate MMB184. An employee of the gas station eventually came outside and told Deputy Lindberg that the males were being weird inside the store and had not purchased anything.
Deputy Lindberg also had not seen the two males carrying any purchases when going to the vehicle. One of the males then left the parking lot and the other one, later identified as JACOB ANTHONY SOCZYNSKI, D. O. B. 10/13/2003, hereinafter "Defendant," got into the driver's seat of the vehicle and started the engine. Defendant then attempted to use the tire air station to fill his tires before parking again behind a semi‐truck in the parking lot. Defendant then drove over to a different parking spot in front of the gas pumps.
Based on his own observations, as well as the information from the store employee, Deputy Lindberg pulled in behind Defendant's vehicle and approached the driver's window. Deputy Lindberg noted that Defendant was sweating profusely and his eyes were heavily dilated. Deputy Lindberg asked Defendant why he was going in and out of the store multiple times. Defendant claimed that he was trying to get video footage from the store because someone had stolen his phone. Deputy Lindberg explained to Defendant how the store employee stated that Defendant had been acting strange.
Defendant replied that he understood how the employee could think that. While talking with Defendant, Deputy Lindberg noticed small pieces of burnt tinfoil near the center radio column by Defendant's right foot. Deputy Lindberg had seen similar burnt tinfoil pieces inside of vehicles on past traffic stops where people had ingested controlled substances. Based on his observations up to that point, Deputy Lindberg asked Defendant if he had ingested any controlled substances lately. Defendant admitted that he used to use cocaine and benzodiazepines, but that was back in January and he was now enrolled in an outpatient treatment program.
Deputy Lindberg returned to his squad car and ran Defendant's information through his database. It showed that Defendant's driver's license was revoked. Deputy Lindberg re‐approached Defendant from the passenger's side of the vehicle. By doing so, Deputy Lindberg noticed a whole roll of tinfoil in the driver's door compartment along with a pen that appeared to have been turned into a homemade pipe. Deputy Lindberg had Defendant exit his vehicle. Deputy Lindberg asked Defendant if there were any controlled substances in the vehicle.
