The Complainant having reviewed the applicable reports believes the following facts to be true: On August 21, 2025 at approximately 11:30 PM officers with the St. Paul police department conducted a traffic stop near the intersection of Blair Avenue and Mackubin Street, in the city of St. Paul, Ramsey County. The officer observed that a vehicle (MN Plate No. PGW-796) appeared to be traveling faster than the speed limit; it then came to a near complete stop at an intersection that was not controlled by a stop sign in the direction of his travel.
The vehicle then stopped in the middle of the road (not at an intersection) further down the street, and the officer now noticed that the vehicle tabs were expired. The officer executed a traffic stop and identified the driver as Quincey Darrell Gavin (MN ID # E655074699516, DOB 01.03.1987), defendant herein. While speaking to the defendant, the officer observed his eyes were somewhat bloodshot and watery, his speech was somewhat slurred and sounded sluggish and they could smell the odor of an alcoholic beverage on his breath.
An opened twelve-pack of beer was visible in the back seat. The defendant was argumentative and aggressive with the officer even from inside his vehicle, and was repeating himself and stuttering. All of this added to the officer's belief that the defendant might be intoxicated. The defendant refused multiple times to produce identification or insurance, and continued trying to argue about the reason he was stopped. Due to his aggressive attitude and apparent intoxication the officer feared the defendant might try to flee, so a terminator was placed under the tires of the vehicle to prevent him driving away.
When the officer explained why this was placed under his tire, the defendant almost immediately stepped out of the vehicle without being directed to do so. To prevent the defendant from trying to flee on foot or fight with officers, the officer told the defendant he was being detained and the officer went to handcuff him. One officer had hold of the defendant's right arm and moved it behind his back, but he could feel the defendant pulling away and trying to get his hand to the front of his body.
The other officer had the defendant's left arm, and could feel defendant trying to pull away as well. An officer told the defendant he was under arrest, but he continued to pull away making it difficult to get handcuffs on his wrists. The help of a third officer was required to get the defendant into handcuffs Upon arrival at the Ramsey County LEC, the officers attempted to conduct field sobriety tests, without success. They then read him a Miranda Warning. The defendant literally got out of the squad car, turned away from the officer during the Miranda warning and tried to walk away.
