Your complainant is employed by the Columbia Heights Police Department. In that capacity, complainant has reviewed official reports and has learned substantially the following: On November 9, 2025, at approximately 1:18 AM, Officer Jacoby Diederich was on routine patrol and observed a motor vehicle (MN plate # [PLATE REDACTED]) run over the curb as it was exiting the El Tequila parking lot northbound on Central Avenue, Columbia Heights, Anoka County, Minnesota. The Officer followed the subject vehicle and observed it swerve within its lane, failed to maintain its own lane and noted the driver activated the turn signal less than 100 feet prior to making a lane change.
The Officer stopped the subject vehicle and spoke with the driver, who was later identified as Florencio Gustavo Pena Romero, [DOB REDACTED], the defendant herein. In speaking with defendant, the Officer detected an odor of alcoholic beverage coming from defendant. Defendant admitted to consuming alcohol prior to driving. Defendant displayed bloodshot and watery eyes, and poor balance. Defendant showed impairment on the following field sobriety tests: horizontal gaze nystagmus; balance on one leg and heel to toe walk.
Defendant blew a fail (0.17) reading on a PBT. After being read a Minnesota Breath Test Advisory, defendant agreed to submit to breath testing. That test revealed the defendant's alcohol concentration to be 0.16 at 2:05 am on November 9, 2025.
