Deputy Reasoner activated his front radar and learned the vehicle in front of him was traveling 68-mph in a 55-mph zone. The vehicle came to the intersection of 117th Street Se and 165th Avenue SE and activated its turn signal and then pulled onto the shoulder of the road. Deputy Reasoner pulled behind the vehicle and activated his emergency lights. Upon making contact with the driver of the vehicle, Deputy Reasoner observed the driver’s eyes to be watery and bloodshot. Deputy Reasoner also noted that the vehicle appeared to be evading law enforcement contact by pulling over on the side of the road when they noticed his squad car.
The driver informed Deputy Reasoner that her and the passenger, later identified as ROBERT LEE PUTNAM, [DOB REDACTED] [hereinafter defendant] were traveling to the casino in Hinckley, MN. Deputy Reasoner considered this to be suspicious because the vehicle was traveling on backroads at an unusual time to avoid detection. Deputy Reasoner also knew the driver from previous law enforcement contact and that the driver had a history of controlled substance use. Deputy Reasoner asked the driver to step out of the vehicle to perform standard field sobriety tests.
The driver also submitted to a PBT. Deputy Reasoner then asked the driver for consent to search the vehicle, to which the driver gave consent. Upon searching the vehicle, law enforcement located a small baggie containing a white crystal-like substance in a black backpack in the backseat. The substance was NIK tested and rendered positive for methamphetamine weighing approximately. 75 grams. The defendant admitted to law enforcement that the backpack belonged to him.
