Your complainant is Detective MacElroy with the South Lake Minnetonka Police Department. In that capacity, your complainant has read the police reports of South Lake Minnetonka Police Officer Weinmann and believes the following to be true: On November 10, 2023, at approximately 9:15 P.M., Officer Weinmann responded to a domestic assault in progress at 836 3rd Avenue, [APT REDACTED] in the City of Excelsior, County of Hennepin, State of Minnesota. W. M. B. Reported that she could hear arguing and someone breaking something in the apartment.
W. M. B. Also reported that she heard a female say, “You pushed me to the ground.” Officer Weinmann responded to the call with South Lake Minnetonka Police Sergeant O’Keefe and with Deephaven Police Officer Schultz. Upon arrival, the officers could hear arguing from the back door of the apartment complex. While Officer Weinmann was getting the keys to the lockbox in the front entryway of the apartment complex, he could hear arguing coming from [APT REDACTED]. Sergeant O’Keefe informed Officer Weinmann that a man wearing a white and black plaid shirt would be making his way to Officer Weinmann from inside [APT REDACTED]. Officer Weinmann made contact with the male in the hallway of the apartment complex and identified him as Nicholas Scott Ellenbaum, [DOB REDACTED], hereinafter Defendant.
Officer Weinmann observed that Defendant had a bloody nose and appeared intoxicated. When trying to speak with Defendant, Defendant stated to Officer Weinmann, “Just let me sit in the f****** chair dude. You’re already going to take me to jail for a very long time so it doesn’t matter.” Officer Weinmann went to [APT REDACTED] and could hear a female, later identified as J. M. S., crying inside the apartment. J. M. S. Would not open the apartment door and stated, “Everything is fine”. After several minutes, J. M. S. Opened the door.
Officer Weinmann observed that J. M. S. Had a fresh black eye and appeared to be in distress. J. M. S. Was extremely hesitant to disclose any information because Defendant told her that if she speaks with the police about Defendant, she would go to jail. J. M. S. Expressed fear in what Defendant and Defendant’s family would do to her if she discloses what happened. J. M. S. Was very worried about “getting in trouble”. J. M. S. Stated that she has been physically abused by Defendant on and off for the past ten years and that the abuse gets worse when Defendant has been drinking.
J. M. S. Stated that she has been driving Defendant to and from work because he has ignition interlock and drinks before he goes to work. J. M. S. Stated that on November 10, 2023, she picked Defendant up from work and he was already mad. J. M. S. Stated that while they were on their way home, Defendant was upset and she tried to reason with him. J. M. S. Stated that Defendant was angry about everything and she felt foolish for trying to engage and figure out what was wrong. J. M. S. Stated that after they got home, she went into the living room to listen to music and do her own thing.
