On November 26, 2025, at approximately 8:00 A.M., Officer Blake of the Austin Police Department was dispatched to the El Parrel located at 210 4th Street NE, in the City of Austin, County of Mower, for a report of a burglary. Officer Blake arrived at the scene and located the owner, E. S. (adult male), P. C. C. (adult male), and KEVIN KHAMSA, DOB/101790, the defendant herein, who was handcuffed. E. S. Told Officer Blake that he had received a call at 7:40 A.M. Telling him that someone had just entered El Parrel.
E. S. Said he and P. C. C. Arrived at the back door and saw the defendant praying next to the Mother Teresa statue that is at the back door of the business. E. S. Said they grabbed the defendant, handcuffed him, and called law enforcement. Blake took the defendant and placed him in the squad car. Officer Blake then went back to retrieve the defendant’s bag that was left inside the building. E. S. Told Blake he found the defendant’s bag, and it contained two computers, an iPad, and three bottles of tequila from El Parrel.
E. S. Stated that the laptops were valued at $2,000.00 each and the value of the iPad was $800.00 Blake photographed the items. Officer Blake advised the defendant he was under arrest and transported him to the Mower County Jail. At the jail, Blake read the defendant the Miranda warning and the defendant agreed to speak with the officer. The defendant told Officer Blake that he was walking by El Parrel and saw the back door was swinging open. The defendant said he knew he should not have gone in, but because of how it was swinging open, he thought the worst.
The defendant said he walked in and was shouting and screaming hello to see if anyone was in the building. The defendant said it was dark and he only saw the TV. The defendant admitted that he had "bad intentions of stealing" and put a couple of items in his bag, including two computers and three bottles of tequila. The defendant said that his intention was to take the items, but he did not take them. He stated that when he saw the Mother Teresa statue, he paused. He said something inside of him said he was better than that, so he stayed and waited.
The defendant said he did not want to leave because it looked bad and that he wanted to say he was sorry. The defendant said the guys were not having it and did not believe him.
