On or about December 8, 2025, at approximately 11:00am, Correction Sergeant Dan Streff informed law enforcement from the Clay County Sheriff’s Office that suspected narcotics had been found in the Clay County Jail. Correction Officer Cole Stoll was conducting a search of cell 212 and found a crystal-like substance wrapped in a paper in an envelope. Stoll believed the substance to be methamphetamine. Marcus Alan Hernandez [DOB REDACTED] ("Defendant") is the only individual housed in cell 212 and has been there for quite sometime.
The envelope where the substance was found was addressed to the Defendant. Due to the suspected narcotics being found, Deputy Grandbois was requested by Clay County Correctional Officers to conduct a K9 sniff. Deputy Grandbois arrived and conducted a K9 sniff with K9 Goose of the Wild Rice pod. Deputy Grandbois gave Goose the seek dope command at cell 212. K9 Goose focused sniffed along the bunk seem and bracketed between the bunk and the table. K9 Goose continued to bracket the area for an extended time.
Due to the change in behavior Deputy Grandbois believed K9 Goose had detected the odor of narcotics. The envelope where the narcotics was located was located on the table in the cell. Sergeant Lambert of the Clay County Sheriff's Officer responded to the Clay County jail and collected the suspected methamphetamine. The suspected methamphetamine field tested positive for methamphetamine but Sergeant Lambert was unable to weigh it. The Defendant has a previous conviction for possession of fentanyl in North Dakota from May 7, 2025. See 09-2024-CR-04471 ### PLEASE TAKE NOTICE: Pursuant to Minn.
