Deputy Bruce knew that SKAALEN had an active warrant for his arrest. When Deputy Bruce walked in and spoke to SKAALEN and told him he was to be arrested, SKAALEN dashed over to a garbage can and threw something into it. Deputy Bruce asked him what he threw into it and SKAALEN said cigarettes, Deputy Bruce asked the establishment’s employees to make sure no one touched the garbage can. Deputy Bruce then arrested SKAALEN and put him into the police car. Deputy Bruce then returned to search the garbage can, an identified employee pointed to a cigarette carton in the garbage can and said that that she saw SKAALEN throw that carton into the garbage can.
Deputy Bruce then took it out and searched it and found a small clear plastic baggie that contained a crystal-like substance, that Deputy Bruce thought to be methamphetamine. That substance was latter field tested and was positive for methamphetamine and it was also weighed; it weighed.86 grams with the plastic bag. At the jail it was also discovered that SKAALEN had $7,636.00 on with him. PLEASE TAKE NOTICE: Pursuant to Minn.
