Deputy Antigua also noted that there was a radar detector on the windshield with the cord hanging down obstructing the driver’s view. Deputy Antigua pulled out behind the vehicle and observed the driver to be JOSEPH RICHARD GOETZE, [DOB redacted] [hereinafter defendant]. Deputy Antigua noted that the driver had a suspended license. Deputy Antigua activated his emergency lights on county road 9, Sherburne County, MN and conducted a traffic stop on the vehicle. Deputy Antigua made contact with the sole occupant, the defendant, who stated he did not have a license and that it was revoked.
Deputy Antigua also observed in plain sight on the passenger seat a purple tinted baggie and a red zippered pouch. Deputy Antigua began speaking with the defendant who appeared extremely nervous, his pupils were constricted, he was displaying droopy eye lids and sweating profusely. Deputy Antigua asked the defendant to step out of the vehicle to which the defendant did not comply. Deputy Antigua again instructed the defendant out of the vehicle and the defendant again refused. Deputy Antigua then physically removed the defendant from the vehicle.
Deputy Antigua noted that during the struggle the defendant was clenching a pack of Marlboro cigarettes, to which he dropped near the vehicle. The defendant was then searched incident to arrest. Deputy Antigua searched the defendant’s vehicle and located the following: Red bag with three hypodermic needles, one which was loaded with a yellow substance. Numerous small baggies with a white powdery substance Deputy Antigua also recovered the pack of cigarettes that the defendant was holding, which contained a purple baggie that contained a large amount of a white crystal-like substance.
In total Deputy Antigua located approximately 35.06 grams of suspected methamphetamine, which was sent to the lab for confirmation testing. PLEASE TAKE NOTICE: Pursuant to Minn.
