Your complainant is Fridley Police Lieutenant Nick Steiger. In that capacity, your complainant has read the code enforcement reports of Fridley Code Enforcement Officer Jordynn Poferl and believes the following to be true: On August 27, 2025, the City of Fridley received a complaint relating to an individual running an auto repair business and parking vehicles on the grass of city-owned property next door to 5847 2 ½ Street NE in the City of Fridley, County of Anoka, State of Minnesota. On August 28, 2025, Code Enforcement Officer Poferl conducted an inspection of the property and observed vehicles parked on the grass next to the driveway of the alley.
Some of the vehicles displayed expired registration and some of the vehicle were inoperable and were parked on the property and on the street in front of the property. On August 29, 2025, a notice was sent to the homeowner, Adrian Gutierrez, [DOB REDACTED], hereinafter Defendant. The notice informed Defendant of the city code violations of inoperable and unlicensed motor vehicles on the property, illegal home occupation, and vehicles need to be kept on a hard surface when parked on the property. The letter instructed Defendant to correct the violations within 14 days.
On September 16, 2025, Code Enforcement Officer Poferl conducted a reinspection of Defendant’s property and observed two vehicles parked on the HRA land, one vehicle parked half on the driveway and half on the grass, and vehicles being repaired at the property. Code Enforcement Officer Poferl observed eight vehicles parked on the street in front of the house. Code Enforcement Officer Poferl spoke with Defendant, who confirmed he was the property owner. Code Enforcement Officer Poferl discussed Defendant’s business and informed him that he cannot run the business from his residential property and informed him that he needed to move the business to a commercial location designated for auto repair.
Defendant said, “Ok.” On September 23, 2025, Code Enforcement Officer Poferl conducted a reinspection of the property and observed one vehicle parked on the HRA land, multiple vehicles parked partially on the grass and partially on the driveway, and that Defendant is clearly still running a business out of the home. Defendant was sent a second letter informing him of the violations and instructing him to have the violations rectified by September 30, 2025, or criminal charges would be brought against him.
On October 6, 2025, Code Enforcement Officer Poferl conducted an inspection of the property and observed two vehicles parked on the grass on the HRA property, one of the vehicles was unlicensed. Defendant was on the property at the time of the inspection and began moving vehicles while Code Enforcement Officer Poferl was present. Code Enforcement Officer Poferl informed Defendant that the vehicles cannot be on the property and that the next time the vehicles are seen on the property they will be towed.
