A sworn officer with the Waite Park Police Department duly states the following facts establish PROBABLE CAUSE: On or about March 24, 2025, at approximately 9:49 P.M., Waite Park Sergeant Andrew Lehmkuhl observed a vehicle, bearing Minnesota license ZFH806, traveling with only one fog light illuminated with no other lights illuminated. Sergeant Lehmkuhl observed the vehicle cross over a lane line and learned the registered owner of the vehicle, Wilson Armando Reyes Jovel, [DOB REDACTED], the defendant herein, had an active warrant.
Sergeant Lehmkuhl initiated a traffic stop at County Road 137 and Dublin Road, within the City of Waite Park, County of Stearns, State of Minnesota. Sergeant Lehmkuhl made contact with the lone driver, whose identity was confirmed as the defendant via a Minnesota Identification Card. Sergeant Lehmkuhl detected an odor of an alcoholic beverage emitting from the vehicle and advised the reason for the stop. Sergeant Lehmkuhl observed the defendant had slurred speech and slow, awkward hand movements.
The defendant admitted he had been drinking. It was confirmed the defendant had an active warrant. The defendant was asked to exit the vehicle. Sergeant Lehmkuhl detected the odor of an alcoholic beverage emanating from the defendant's person. The defendant was requested to perform Standardized Field Sobriety Tests and he agreed. The HGN was explained, the defendant averted his eyes slightly, and would not follow Sergeant Lehmkuhl's finger. Based on the defendant's inability to follow instructions, a PBT was administered with a registered result of.208. The defendant was placed under arrest and was transported to the Stearns County Jail.
Upon arrival, at approximately 10:35 P.M., Sergeant Lehmkuhl read the Minnesota Breath Test Advisory twice to the defendant. The defendant stated he understood the advisory and wished to consult with an attorney. It was explained multiple times over an approximately 15-minute period that telephone and directories were available. Attorney time was concluded after seven attempts and a reasonable amount of time. The defendant agreed to complete a breath test. At approximately 11:05 P.M., the test was administered using the DataMaster DMT. The registered results of the defendant's test revealed a breath alcohol concentration of 0.19. The defendant's driving record states his status or privilege to drive in the State of Minnesota was revoked for a Driving While Impaired offense on December 23, 2024 and had not been reinstated as of March 24, 2025. Complainant has reason to believe and does believe that all of the above information is true and correct.
The above facts constitute the complainant's basis for believing that the above-named defendant, on or about March 24, 2025, in the City of Waite Park, County of Stearns, State of Minnesota, committed the described offenses.
