On May 1, 2026, at approximately 6:32 P.M., police effectuated a traffic stop near Kellogg Boulevard and Seventh Street West in St. Paul, Ramsey County, Minnesota. As the officer approached the driver’s door and the driver rolled down the window, the officer could see smoke coming out of the window. The smoke was similar to that of marijuana. As the officer spoke with the driver, ASANTE ZACCAI JONES OSGOOD – [DOB REDACTED], he observed a THC vape pen in the center console. JONES OSGOOD confirmed that it was a THC vape pen.
When informed that he could not smoke that while driving, JONES OSGOOD responded that he previously smoked in the vehicle approximately an hour earlier, which was inconsistent with the officer’s observation of smoke coming out of the vehicle when he rolled the window down. The officer removed JONES OSGOOD from the vehicle and asked if there were any other THC products in the vehicle. JONES OSGOOD replied that there were additional THC products under the armrest that were sealed and new. When asked if there was anything else in the vehicle, JONES OSGOOD responded that there was a firearm on the floor.
When asked if he had a permit to carry, JONES OSGOOD said that he did not and was in the process of obtaining one as he moved to Minnesota recently. JONES OSGOOD reported that he was from Virginia, which is an open carry state. JONES OSGOOD later told police that he had lived in Minnesota for two years. Police located a Glock 17 firearm under the driver’s seat. The magazine was loaded, but there was no round in the chamber. Police located a second firearm, possibly a Glock 19, with an extended magazine inside the center console.
The firearm did not have a serial number, and it was equipped with a machine gun conversation device, most commonly known as a switch. The second firearm also had a loaded magazine, but there was no round in the chamber. Under the arm rest, police located several sealed bags of marijuana. JONES OSGOOD was taken to the Ramsey County Jail. A certified Drug Recognition Evaluator (DRE) responded to perform an evaluation on JONES OSGOOD. The DRE noted that JONES OSGOOD’s eyes were bloodshot and watery.
The DRE observed distinct and sustained nystagmus at maximum deviation in both eyes and the onset for nystagmus prior to 45 degrees in both eyes. In addition, the DRE noted a lack of convergence in JONES OSGOOD’s eyes. During the walk and turn test, JONES OSGOOD stepped off the line. During the one leg stand test, JONES OSGOOD swayed and used his arms to balance. Based on the evaluation, the DRE’s opinion was that JONES OSGOOD was impaired by cannabis and suspected that JONES OSGOOD was additionally impaired by a CNS depressant.
Pursuant to a search warrant, police obtained a blood sample from JONES OSGOOD.
