That your complainant is a peace officer employed by the Rochester Police Department, who was advised of the following by Officer Christopher Weber, a law enforcement officer with that agency, known to your complainant to be truthful and reliable: That on November 30, 2025, at 7:16 P.M., Officer Weber responded to a call regarding a driver passed out in.a Subaru bearing Minnesota registration of GRD372, hereinafter referred to as the “vehicle,” at 2729 Whynaught Cout SE in the City of Rochester, County of Olmsted.
Officer Weber approached the vehicle and saw that the driver of the vehicle was unconscious, but breathing. Officer Weber identified the driver as Joseph Arnold Schultz, 5/30/1966, hereinafter referred to as “Defendant.” Officer Weber observed that (1) Defendant had a strong odor of an alcoholic beverage; and (2) Defendant’s eyes were glassy and bloodshot. Defendant admitted to drinking alcohol prior to driving. When they exited the vehicle, Defendant was unsteady on their feet. Officer Weber administered standardized field sobriety tests and observed clues suggesting intoxication.
Officer Weber administered a preliminary breath test to Defendant, which measured Defendant’s alcohol concentration at.154. Based on Defendant’s performance during field sobriety testing, speech, balance, appearance, and admissions, Officer Weber believed Defendant to be under the influence of an alcoholic beverage. Once at the Olmsted County Adult Detention Center, Officer Weber read Defendant the Breath Test Advisory. Defendant elected not to speak with an attorney prior to making the decision whether to provide a chemical test.
Defendant agreed to provide a breath sample for alcohol concentration testing. Defendant submitted to a breath test using the DMT instrument, which measured Defendant’s alcohol concentration at. 18 on November 30, 2025, at 10:24 P.M. PLEASE TAKE NOTICE: YOU MUST APPEAR FOR EVERY COURT HEARING REGARDING THIS CASE. FAILURE TO APPEAR FOR COURT IS A CRIMINAL OFFENSE AND MAY RESULT IN ADDITIONAL CRIMINAL CHARGES BEING IMPOSED AND PUNISHED AS PROVIDED IN MINNESOTA STATUTES SECTION 609.
