On November 28, 2025, Officer Bonczek of the Lino Lakes Police Department was on routine patrol when he observed a vehicle going southbound in the northbound lanes of I35W in the city of Lino Lakes, Anoka County, Minnesota. Officer Bonczek caught up to the vehicle and began to drive parallel to the vehicle southbound in the southbound lane until the vehicle conducted a U-turn in an emergency turn around. Officer Bonczek then got behind the vehicle and initiated a traffic stop. Officer Bonczek made contact with the driver, identified as Cynthia Eve Grover, [DOB REDACTED], Defendant herein.
Officer Bonczek observed Defendant’s eyes to be blood shot and watery and her speech to be slowed and slurred. He also observed an open bottle of Modelo beer in the center console of the vehicle. When asked if she had anything to drink, Defendant replied “a few things” and indicated it was “not that long ago.” Officer Bonczek requested Defendant to step out of the vehicle to conduct field sobriety tests and noticed an odor of alcohol coming from Defendant. Defendant agreed to perform the horizontal gaze nystagmus test and Office Bonczek noticed several indicia of impairment during the test.
Officer Bonczek requested Defendant to provide a PBT sample but Defendant only blew into the PBT machine with a very short and brief breath, not providing a valid sample. Defendant was transported to the Lino Lakes Police Department to provide a DMT breath sample. Defendant was provided with a phone to contact an attorney and was informed that refusal to take the DMT test was a crime. When asked to provide the breath sample, Defendant began to cry and asked to be taken to jail. Eventually, Defendant agreed to provide a breath sample but did not provide a continuous breath and no valid reading could be obtained.
Defendant was given another opportunity to complete the test and provided one sample with a result of a.242 BAC. However, due to an operator error, a second sample was not initiated and the test sequence had to be restarted. Officer Bonczek told Defendant that two additional breath samples would have to be provided for a valid test. However, Defendant again did not provide sufficient continuous breaths for a valid reading. When Officer Bonczek informed Defendant that she would be charged with refusal to provided a breath test, Defendant became agitated and told officers “I am going to bail out regardless.
Like whatever the f** money y’all want I don’t give a f**, I’ll give y’all $10,000 each on my soul.” Defendant later told officers “I would give y’all at least $500 of native money” and “what do y’all want? $500?” Defendant has a prior misdemeanor DUI conviction from September 20, 2024, out of Ramsey County, court file 62-CR24-2608.
