M., Officer Erik Wilson, of the Saint Cloud Police Department, was dispatched to a local gas station on the 700 block of 15th Avenue Southeast, in the city of Saint Cloud, Sherburne County, Minnesota, for the report of a possible medical. Dispatch advised Officer Wilson that the complainant, a store employee, stated that a male went into the bathroom, he was not answering, and they were having difficulty making contact with him. Officer Wilson arrived on scene, knocked on the bathroom door, and announced himself.
Officer Wilson then heard the individual in the bathroom say, "Oh s***." The individual, later identified as ABDULLAHI HASHI DAUD, [DOB REDACTED], hereinafter "Defendant," eventually opened the bathroom door. Officer Wilson asked Defendant is he was alright. Defendant stated he did not need medical assistance. Defendant explained that he had gone into the bathroom to seek shelter from the wind and cold outside. Officer Wilson ran Defendant's information through his database and noticed that there was an active felony warrant out for him from Wright County.
Officer Wilson confirmed the warrant and then placed Defendant under arrest. Officer Wilson conducted a search of Defendant, and located a glass pipe consistent with methamphetamine usage. Officer Wilson also observed a rolled up paper towel around some straws. Officer Wilson asked Defendant what was in the paper towel. Defendant claimed it was just straws. Officer Wilson looked closer and observed tinfoil. Through his training and experience, Officer Wilson was aware that this was usually used in connection with smoking illegal narcotics.
Officer Wilson checked the contents of the paper towel and observed a bindle with a white powdery crystal‐like substance. Officer Wilson eventually weighed the substance, which was 1.5 grams with packaging. Officer Wilson also tested the substance using a NIK kit, which tested positive for the presence of methamphetamine. Methamphetamine is a Schedule II controlled substance. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
