That on or about September 14, 2025, at approximately 20:12 hours, Minneapolis Police Officers were dispatched to a two-vehicle crash at St. Anthony Parkway and Johnson St. NE in the City of Minneapolis, Hennepin County, Minnesota, where a 911 caller reported that the driver of the striking vehicle smelled of alcohol. Upon arrival Officer K. Z. Located a red Toyota Rav 4 (MN #DEJ562) and a gold Chevy Malibu (MN #RPA991) parked in the corner of the intersection. The Malibu was running with the key in the ignition; the officer asked who was driving the Malibu and a male identified by his DVS photo as DEMETRIUS DAMON NEAL, [DOB REDACTED], Defendant herein, admitted he was the driver.
The driver of the Rav 4 was identified as V. S. S. T., Victim herein. The officer observed that Defendant’s eyes were watery, and he smelled an odor of a consumed alcoholic beverage coming from Defendant’s breath when he spoke. Victim told Officer K. Z. That she was driving northbound on Johnson St. At St. Anthony Parkway and was stopped at a red light when Defendant rear-ended her vehicle; Victim’s vehicle had minor rear end scuff marks to the bumper and back door. Defendant stated that he was driving northbound on Johnston St. NE and stooped at the red light at S. Anthony Parkway, he let off the brake slightly and his vehicle rolled into Victim’s vehicle, in a low speed rear-end contact.
Officer K. Z asked Defendant when he had his last alcoholic drink and Defendant stated he consumed one beer, a Michelob Gold, approximately 6 hours prior to driving; Defendant stated he was driving to a friend’s house for a fantasy football draft party when the crash occurred. Based upon the above observations and Defendant’s admission, Officer K. Z. Decided to perform Standardized Field Sobriety Tests (SFSTs) on Defendant. The officer performed the Horizontal Gaze Nystagmus test on the Defendant, observing 5 out of 6 clues of impairment, the Walk and Turn Test, observing 6 out of 8 clues of impairment, and the One Leg Stand test, observing 3 out of 4 clues of impairment.
During the SFSTs Defendant stated, “Yeah, I’m cooked.” The officer also performed a Preliminary Breath Test (PBT) on Defendant, resulting in a reading of.24. Based on the above observations, Defendant’s admission and his performance on the above tests, Defendant was placed under arrest for DWI and transported to the Minneapolis Traffic Unit for further testing, where Officer K. Z. Read the Breath Test Advisory to Defendant at 9:10 P.M. Defendant indicated he understood the Advisory and did not wish to speak to an attorney.
Officer K. Z. Then asked Defendant if he would take a breath test and Defendant agreed to a breath test, which revealed an alcohol concentration of.24 at 9:32 P.M.
