He also saw that the rear of the second trailer was dragging on the ground and that there were no operational lights. Officer Muschik tried to initiate a traffic stop as the vehicle approached the intersection of Northland Drive and Rum River Drive, but it continued to drive even as the rear trailer tire hit the center median, nearly taking out a street sign. The vehicle did not stop until Officer Muschik activated his siren. Officer Muschik approached the vehicle and identified the driver as LAYNE ALLAN LARUE, [DOB REDACTED], the above‐named Defendant.
By the time Officer Muschik approached the vehicle, the Defendant was outside it and standing next to the second trailer, tightening up a ratchet strap that was connecting both the trailers together. Officer Muschik told him he could not pull two trailers as it was a hazard. The Defendant said that he lost his side‐by‐side somewhere and was going back to locate it. However, he did not provide an explanation for why there were two trailers attached to his vehicle. The Defendant started to walk away from Officer Muschik and Officer Muschik followed, telling the Defendant he needed to detach the second trailer because it was not safe.
The Defendant did not stop or listen to Officer Muschik and instead began to drive his vehicle forward. Officer Muschik told the Defendant to stop, and the Defendant got out of the vehicle. He was again told to detach the second trailer and was told it was going to be towed. The Defendant then took a knife and began to cut the straps connecting the two trailers. Officer Muschik told the Defendant to put the knife down. Officer Muschik then saw a crossbow on the second trailer and took possession of it.
While Officer Muschik was walking to his squad with the crossbow, the Defendant started to drive away. Officer Muschik got into his squad to follow the Defendant. The second trailer eventually broke off on the onramp of HWY 169 from Rum River Drive. The Defendant then turned into oncoming traffic. While he was in the wrong direction on the on ramp, the Defendant was commanded by law enforcement to stop the vehicle and step out. Officers had to repeat their instructions multiple times before the Defendant complied.
Once out of the vehicle, officers told the Defendant to put his hands behind his back. Instead, he started to drink a beverage. Officers told him several times to stop, but Defendant refused. Officers eventually removed the can from Defendant’s hands and placed them behind his back. PLEASE TAKE NOTICE: Pursuant to Minn.
