M., Officer Gordhamer was conducting vehicle registration checks on vehicles at the Holiday Gas Station located on West 78th Street in the City of Eden Prairie, County of Hennepin, State of Minnesota. Officer Gordhamer conducted a registration check on a vehicle displaying Minnesota registration GNZ947 and learned that a female affiliated with the vehicle had a warrant. Officer Gordhamer observed a female in the front passenger seat of the vehicle. The vehicle left Holiday Gas and drove onto Flying Cloud Drive.
Eden Prairie Police Officer Shoger assisted Officer Gordhamer and Officer Shoger activated his squad car’s emergency lights and stopped the vehicle. Officer Shoger and Officer Gordhamer approached the vehicle and Officer Gordhamer explained the reason for the stop. Officer Gordhamer identified the female passenger by her Minnesota driver’s license as Joy Shamon Ross, [DOB REDACTED], hereinafter Defendant. Officer Gordhamer observed that Defendant smelled of a consumed alcoholic beverage. Defendant stated that she had been drinking and that the male driver was her sober ride.
Officer Gordhamer conducted a computerized check on Defendant and confirmed that she was valid and clear and not the person on the warrant. Officer Gordhamer returned to the vehicle and opened the front passenger door to speak with Defendant. Officer Gordhamer observed a black handgun in the door pocket on the passenger door. Officer Gordhamer asked Defendant if the gun was real or if it was a BB gun. Defendant stated the gun was real and that it was not her gun. Officer Gordhamer removed the gun from the door and observed that it was a Tarus Millennium PT111 G2 9 mm with serial number TJM41306 and that it was loaded with 13 bullets, 12 in the magazine and one in the chamber.
A bullet ejected from the racking slide when Officer Gordhamer racked the slide. Defendant stated that the car belonged to her daughter and that the primary driver of the car was her daughter and also that “the woman with the warrant drives the car too”. Defendant stated she did not have a permit to carry in the State of Minnesota or in any other state.
