Your complainant is employed by the Minnesota State Patrol. In that capacity, complainant has reviewed official reports and has learned substantially the following: On December 7, 2025, at approximately 12:51 am, Trooper Ginter responded to the report of a vehicle that went off the road and struck the sound wall in the area of I‐94 and Highway 100 in the City of Brooklyn Center, County of Hennepin, State of Minnesota. Trooper Ginter located the crashed vehicle and observed that the vehicle had left the roadway, struck a light pole, struck the sound wall, and stopped in the ditch.
Trooper Ginter observed that the driver’s seat was occupied by a male suspect later identified as Durante Demar Williams, [DOB REDACTED], the defendant herein. Trooper Ginter observed that the vehicle was running and the defendant was attempting to drive it out of the ditch. Trooper Ginter noticed that the defendant had an odor of alcohol and bloodshot, watery eyes. The defendant initially denied driving, but Trooper Ginter confirmed with the original reporting party that the male occupant of the vehicle was driving at the time of the crash.
The defendant agreed to perform the horizontal gaze nystagmus test, on which Trooper Ginter observed multiple clues of impairment. The defendant agreed to submit to a PBT which recorded a BAC of 0.150. The defendant was placed under arrest for driving under the influence of alcohol. During an inventory search of the vehicle, Trooper Ginter located two handguns, including a P80 9mm pistol with one round in the chamber under the front passenger seat, within reach of the defendant. The defendant was read the Minnesota Breath Test Advisory and declined an opportunity to contact an attorney.
The defendant refused to submit to a DataMaster breath test. The defendant was read the Minnesota Firearms Breath Test Advisory, after which he again refused breath testing. A record check through the Department of Public Safety, Driver and Vehicle Services Division, revealed that the defendant’s driving privileges were cancelled as inimical to public safety in Minnesota and had not been reinstated to the date of this offense. The record check also confirmed that the defendant has three prior non‐ enhanceable DWI convictions, outside of ten years, from 2004, 2005, and 2011. Trooper Ginter also confirmed that the defendant did not have a valid permit to carry.
