On or about February 25, 2024, at approximately 11:37 P.M., Trooper Culbeaux with the MSP was on patrol when he observed on I-94 westbound, in Minneapolis, Hennepin County, MN a Dodge Grand Caravan (WI license plate [PLATE REDACTED]) weaving over lane lines. The trooper maintained visual contact and further observed it drifted within its lane, then drove its driver’s side tires over the left lane line, jerked its wheels left, weaved over the left lane line, returned to its lane, drifted right, then jerked it wheels left again.
A TLE was initiated near Lowry Ave. Upon approach, the trooper observed a male driver and sole occupant. The driver was identified by Wisconsin DL as being Aherns, Jesse Lee, [DOB REDACTED], Defendant herein. Before the Trooper could inform him why he was pulled over, Defendant apologized and spontaneously stated he was headed home, tired, had a bad strut on his driver side tire and admitted he knows he is not supposed to be driving. As he spoke, the trooper observed Defendant had an excited demeanor, fast hand movements, curled his fingers uncontrollably/incessantly, had tense and rigid muscles and watery eyes.
Based on his training and experience, the trooper suspected Defendant was impaired by a street drug. When asked about any recent drug usage, Defendant initially denied drug usage but admitted to taking prescription medication. Defendant exited his vehicle and SFSTs were administered. No HGN clues were observed but the trooper observed that Defendant’s eyes darted from side to side ahead of his stimulus, indicating the influence of a stimulant type of drug. The trooper further noted a lack of convergence in Defendant’s right eye and that his right eye drifted down.
During the OLS test, the trooper observed clues of impairment as Defendant used his arms to balance and swayed while balancing. During the WAT test, several clues of impairment were observed as Defendant did not touch heel to touch, used arms to balance, stopped while walking, and his body and gait were rigid which further indicated he was under the influence of a stimulant. A PBT was administered which resulted in.000 BAC, further indicating to the trooper that Defendant was impaired by a stimulant drug.
A MRT was then administered during which the trooper further observed that Defendant swayed front to back approximately four inches each way, his facial muscles were rigid/tense, his eyes did not fully close. Based on his training and experience, the trooper concluded Defendant was under the influence of a street drug, a possible Central Nervous System Stimulant. Defendant was arrested for DWI, his vehicle towed, and he was transported to HCMC. A Court order was obtained for a sample of Defendant’s blood or urine.
Defendant was informed that refusal to provide a blood or urine sample is a crime. Defendant agreed to provide a blood sample. At 1:17 A.M., a registered nurse collected a blood sample from Defendant. The blood sample was analyzed by the BCA and found to contain the presence of amphetamine and methamphetamine, both of which are a Schedule II Controlled Substance.
