In the second tin foil packet, Officer Miller located a small piece of folded paper. Officer Miller carefully unwrapped the paper and observed a white powdery substance. The Defendant was placed under arrest and transported to the Edina Police Department for booking. Edina Police Officer Zech, a certified Law Enforcement Drug Recognition Evaluator, responded to the booking area. Officer Zech read the Defendant his Miranda Rights, which he stated he understood. Following the Drug Recognition Evaluation, Officer Zech was of the opinion the Defendant was under the influence of a narcotic analgesic and cannabis and unable to operate a motor vehicle safely.
Officer Miller measured the white powdery substance, which weighed 0.05 grams and field tested positive 3 27-CR-25-29855 Filed in District Court State of Minnesota 11/25/2025 for methamphetamine. Officer Miller drafted an application for search warrant and electronically transmitted it to the Honorable Sarah Hudleston. Judge Hudleston reviewed and signed the warrant. Officer Miller explained the warrant to the Defendant. The Defendant agreed to take a blood test. Officer Zech, a certified Law Enforcement Phlebotomist, performed a blood draw from the Defendant.
The blood samples were later transported to the Minnesota Bureau of Criminal Apprehension, Forensic Science Laboratory, for analysis. Officer Miller spoke with the Defendant. The Defendant agreed to provide a statement. The Defendant stated the vehicle belongs to a family member and he did not have permission to drive it. The Defendant stated he drove to the parking lot and does not remember what happened. The Defendant estimated about five minutes passed from the time he went unconscious until officers arrived.
The Defendant stated he used the vape pen approximately fifteen minutes prior to officer arrival. The Defendant admitted the methamphetamine located in the tin foil belonged to him and he last used it two days prior. The Defendant stated he keeps the brass knuckles for protection.
