Your Complainant is a Detective with the Edina Police Department and based on the files, records, and reports of said Department, your Complainant alleges the following: On June 23, 2025, at approximately 10:02 A.M., Edina Police Officer Miller was dispatched to the Lunds & Byerly’s Store, located at [ADDRESS REDACTED], in the City of Edina, County of Hennepin, State of Minnesota, on the report of suspicious activity. The Reporting Party stated a male was slumped over in the driver’s seat of a vehicle, which was in reverse and stuck against a curb.
Officer Miller arrived on-scene and observed a Dodge Grand Caravan, bearing Minnesota license plate [PLATE REDACTED], with its reverse lights illuminated. Officer Miller observed a male in the driver’s seat of the vehicle with his chin touching his chest and appearing to be sleeping. The male was later identified as Enrique Romano Garcia, [DOB REDACTED], the Defendant herein. Officer Miller observed the vehicle in the back of the parking lot, not in a parking stall, and was positioned in a manner where no vehicles could drive in the lane of travel.
Officer Miller positioned his squad car in front of the vehicle to ensure it did not drive away. Officers Miller and Martin approached the vehicle as the Defendant woke. Officer Miller informed the Defendant to place the vehicle in park. Officer Martin reached into the vehicle and turned the vehicle off. The Defendant stated the vehicle was parked in such a position due to the fact he was tired. Officer Miller observed the Defendant’s eyes were watery. Officer Miller asked the Defendant about drug usage, and the Defendant responded he consumed THC. Officer Miller observed a vaping device positioned between the Defendant’s legs.
The Defendant confirmed there was THC in the vaping pen and that he had used the vaping pen just prior to officer arrival. Officer Miller asked the Defendant about additional drug usage, and the Defendant denied any further drug usage. Officer Miller observed two pieces of tin foil in the driver’s side door pocket with a lighter next to it. Officer Miller asked the Defendant about the two pieces of tin foil, and the Defendant stated there was Fentanyl in it. The Defendant stated the last time he used Fentanyl was three days prior.
The Defendant was asked out of the vehicle and Officer Miller observed he was sweating profusely. The Defendant stated he had a knife in his right pants pocket. Due to the weapon and suspected narcotics, Officer Miller informed the Defendant he was being detained. A search of the Defendant was performed during which Officer Miller located in the Defendant’s pants pocket a knife that had brass knuckles affixed to it. A vehicle search was performed. In one of the tin foil packets Officer Miller observed a dark brown substance which, based on training and experience, Officer Miller was aware the substance was a smoked narcotic.
