On November 1, 2025, Sergeant Wagner of the Olmsted County Sheriff's Office was on active patrol, driving eastbound on Highway 14 in the City of Byron, Olmsted County. At approximately 11:51 P.M., Sergeant Wagner observed a vehicle stopped partially on the shoulder of the road near the 600 block of Country Club Rd. SE. Sergeant Wagner stopped to check on the vehicle and made contact with the driver. The driver and sole occupant was identified as Ricky Darany Ngeth ([DOB REDACTED]). While speaking with Ngeth, Sergeant Wagner observed he appeared to be dazed and had watery eyes.
Ngeth told Sergeant Wagner that he stopped because he was tired and was not aware of where he was. Ngeth admitting to drinking and rated his feeling of intoxication on a scale of 0-10 as a 2. On this basis, the following field sobriety tests were conducted: - Horizontal Gaze Nystagmus, which revealed six indicators of impairment; - Walk and Turn, which revealed four indicators of impairment; - One Leg Stand, which revealed three indicators of impairment; and - Preliminary Breath Test, which revealed a blood alcohol concentration (BAC) of approximately 0.184. Ngeth was arrested for driving while impaired (DWI) and transported to the Olmsted County Adult Detention Center (ADC). At the ADC, Ngeth was read the breath test advisory and declined to talk to an attorney.
Ngeth agreed to take a breath test which revealed a BAC of approximately 0.20 at 12:59 A.M. A subsequent review of Ngeth's criminal history revealed one qualified prior impaired driving incident within the last 10 years -- a conviction for DWI on April 13, 2016, in ••-CR-••-••••.
