On 03/20/2026, Hennepin County Sherriff’s deputies were on a routine patrol when they observed a red 2006 Pontiac Vibe driving eastbound on 26th Street East in Minneapolis, Hennepin County, Minnesota. The vehicle immediately turned south on Portland Avenue. The lights for southbound on Portland Avenue were green and the Pontiac did not yield for southbound traffic before making the right turn. The deputies followed the vehicle and observed the vehicle merging two lanes to the left without signaling.
The deputies learned that registered owner’s driver’s license was revoked. The deputies activated their squad’s emergency lights to initiate a traffic stop. The driver of the vehicle provided the deputies with a Minnesota ID and was identified as DELAJUANTE ROMEL MOORE [DOB REDACTED], Defendant herein. The deputies could smell the odor of alcoholic beverage from Defendant as they were speaking with him. Defendant was slurring his speech. Defendant was the registered owner of the vehicle and his driver’s license was revoked.
When asked how much he had to drink, Defendant stated one drink and that it was a shot of a liquor. Defendant told the deputies that he had a TBI when he was 2 years old and his balance was not well. The deputies observed the following during a field sobriety test: - Defendant lacked smooth pursuit in both eyes and he presented with distinct and sustained nystagmus at maximum deviation in both eyes. The nystagmus prior to 45 degrees. - During the walk and turn test, the deputies observed that Defendant placed his feet together heel to toe and started to fall.
The deputy grabbed Defendant for his safety and disconnected the test. When asked if he would provide a PBT sample, Defendant refused. Defendant was placed under arrest. Upon arrival at the Hennepin County jail, Defendant demanded that he needed to use a bathroom or he would urinate on himself. The deputy walked Defendant to a porta-potty in the garage of the jail and uncuffed one of Defendant’s wrists. Defendant immediately opened the door to the porta-potty and began urinating the stall. Defendant ignored commands to wait until he was completely handcuffed.
Defendant then turned around and attempted to urinate on the deputies. Defendant stated he was going to “p*** on their ass” when he was pushing the door open and directing his penis towards the deputies attempting to urinate on them. One of the deputies immediately closed the door to avoid Defendant’s urine. There was urine all over the floor outside of the porta-potty. The deputies read Defendant the Breath Test Advisory and provided Defendant opportunity to speak with an attorney. Defendant provided a breath sample of.23g/210L within two hours of the stop.
Defendant became upset with how long the process was taking and started kicking the rear of the deputies’ squad and pulling on steel wire screen with both hands causing significant damage. The squad was taken out of service due to the damage.
