The vehicle that PELKEY was driving (GTX186) was a 2001 silver four-door Ford, matching the description given by the 911 caller. Officer Vernier reviewed PELKEY’s ELS file and observed that he did not have a deer hunting license purchased for 2025. At the time of the incident, DANIEL JAMES PELKEY, [DOB REDACTED], was on supervised release from the Minnesota Department of Corrections, and he signed a document listing his conditions of release, including: “The offender must refrain from purchasing, possessing, accessing, or controlling any type of firearm, ammunition, or dangerous weapon, including replica weapons.
The offender must not be found in the presence of a firearm, including those found in a vehicle where the offender is also present.” Corporal Lange completed an inventory search of the vehicle and located a 9mm firearm round. 4 34-CR-25-728 Filed in District Court State of Minnesota 12/8/2025 The 9mm round and the wallet were logged into evidence. At the hospital, Deputy Kubesh asked PELKEY if he would provide a PBT sample, and he said, no. Subsequently, a search warrant was obtained to PELKEY’s blood and was submitted to the BCA for analysis.
On 11/20/2025, Deputy Kubesh received a toxicology report for BCA Blood Kit #B471723 which indicated the presence of amphetamine with a concentration of 0.118. DANIEL JAMES PELKEY, [DOB REDACTED], was previously convicted of DWI - Operate Motor Vehicle - Alcohol Concentration 0.08 within 2 Hours (169A.20.1(5)) in Case No. 34-CR-24-552 on 02/04/2025. DANIEL JAMES PELKEY, [DOB REDACTED] was convicted of Assault-1st Degree-Great Bodily Harm (609.221.1) in Case No. 34-CR-15-46 on 10/13/2015. DANIEL JAMES PELKEY, [DOB REDACTED] has a revoked driver’s license and was subject to the ignition interlock program at the time of this incident per his Driver’s License Record.
