On December 21, 2025, at approximately 11:25 am, Saint Cloud Police were dispatched to a 911 open line mapping within 297.7 meters of an address on the 2600 block of 15th Street North in the City of St. Cloud, County of Stearns. Dispatch advised they had received a 911 hang up but could only hear a female crying and a male talking in the background before the female hung up. Dispatch attempted to call back and it went straight to voicemail. Officers also attempted to contact and locate the caller but were unable to get a response outside of a few text messages.
Later that same day, around 2:16 pm, Officer Schreiner received another text message in Spanish from the number advising they did not speak English. Officer Schreiner texted back in Spanish to attempt to locate the individual, who was later identified as I. E. I. E. Responded saying she could only give the person's name and sent two pictures of an ID belonging to Jose Luis Espinoza Rivas ([DOB REDACTED]), Defendant herein. Officer Schreiner continued to attempt to locate I. E. With no response, and advised that if I. E. Needed more help, she should call 911. At around 3:26 pm, dispatch received a 911 call from the same number on the language line, and advised officers I. E. Was at a location on the 1200 block of 15th Street North and was near the apartment.
Officer Schreiner arrived at the address and located and identified I. E. Officer Schreiner was able to speak with I. E. Through a Spanish translator on scene. I. E. Told Officer Schreiner that Defendant had sexually assaulted her the previous evening, December 20, saying he forced her to do things she didn't want to do. I. E. Told Officer Schreiner she had been trying to get away but was scared Defendant was going to do something to her. Given what I. E. Reported, Officer Schreiner asked I. E. If she was willing to go to the hospital for a sexual assault examination, and I. E. Agreed.
I. E. Was wearing the same clothes from the previous night and had not showered since she was assaulted. I. E. Also told Officer Schreiner she and Defendant were in a relationship but had not had consensual sex in about three months. While at the hospital, Officer Schreiner took a more detailed statement from I. E. The previous evening, December 21, 2025, I. E. Reported Defendant had been drinking that evening so she was trying to stay away from him. Around 9:30 pm, I. E. Went to the bedroom because she thought Defendant was asleep.
I. E. Realized when she laid down that Defendant was not actually sleeping because he started grabbing at her hands, saying "allow me." I. E. Told Defendant to let her go and went on to the floor to get away from Defendant. Defendant picked her up and put her back up on the bed where he forced her to have vaginal sex. I. E. Reported Defendant held her hands down on the bed next to her head while he did so, was not using any form of protection, and had ejaculated inside of her. After it was over, I. E. Got off the bed, sat down in a chair in the bedroom, and was crying.
