In the early evening of February 27, 2026, officers with the Rochester Police Department were called to a restaurant in the City of Rochester, County of Olmsted. On arrival, they found a man ("Victim") bleeding from the face. He reported that he was working a shift behind the counter at the restaurant when David Deangelo Colon entered and struck him in the face without provocation. Victim also showed officers threatening text messages that Colon had sent him prior to the attack. With assistance from restaurant management, officers reviewed surveillance video.
It shows Colon enter the restaurant through the front door. He approaches Victim and throws a water bottle at him. He then approaches Victim [NAME REDACTED]. Victim [NAME REDACTED], and Colon falls to the ground. Victim then tries to help Colon to his feet, but Colon keeps trying to hit him. Victim eventually manages to push Colon out the front door of the restaurant. Officers examined Victim and noticed a significant disfiguring laceration on his face. They also saw cuts and lacerations on his hand so deep that the bones were visible.
Officers spoke with Colon and noticed a strong odor of alcohol, as well as bloodshot eyes and slurred speech. They were also aware from witness statements and from his admission that he had driven to the restaurant with his eleven-year-old child. Based on this, they began a DWI investigation. Due to injuries from the fight, Colon was unable to attempt most field sobriety tests, but officers did request a preliminary breath sample. Colon refused that sample. Officers read him the implied consent breath test advisory.
They asked Colon if he would take a breath test. He replied, "No." PLEASE TAKE NOTICE: YOU MUST APPEAR FOR EVERY COURT HEARING REGARDING THIS CASE.
