On April 28, 2026, at approximately 11:41 A.M., Osseo Police Officers were dispatched to car accident at 33 4th Ave NE, Osseo, Hennepin County. Upon arrival, officers spoke to witnesses that stated a vehicle had left the roadway to the south, cross over the sidewalk, strike a row of landscaping shrubs and hit a tree in the yard of 33 4th Ave NE. Officers observed the landscaping and grass to be disturbed consistent with a vehicle losing control on it. One witness said he approached the lone male driver who he described as a white male, approximately 55 years of age, with grey/black hair, to see if he was injured.
The driver, later identified as MATTHEW ROBERT DAVIS, [DOB redacted], hereinafter "Defendant," didn't really respond, appeared dazed, and the witness thought he was drunk. He said the Defendant then fled the scene in the vehicle northbound on 4th Ave NE, turning eastbound onto 2nd ST NE. He said Defendant fled the scene approximately 2 minutes prior to officers' arrival. Other officers located the Defendant's vehicle and conducted a traffic stop. The witness responded to the location and positively identified the Defendant as the driver who hit the tree.
Officers noted signs of impairment when talking with Defendant and noted signs of impairment when he did the HGN test, the Walk and Turn test, and the One Leg Stand Test. The Defendant was given a PBT but he refused to submit to a sample. Defendant was placed under arrest and brought to the Osseo Police Department. At the Osseo Police Department, the Defendant was read the Breath Test Advisory at 12:34 P.M. The Defendant stated he wished to consult with an attorney. Officers provided him time to contact an attorney; however, he later stated that he could not do so because he was too embarrassed.
He then asked if he could speak with someone other than an attorney, and officers advised him that this was his opportunity to speak with an attorney only. They then gave him additional time to decide, and he stated that he wanted to speak with an attorney but that it was pointless because he could not hear. He then remained quiet. Officers finally asked Defendant three times if he was willing to take the breath test. He repeatedly stated that he needed to speak with an attorney before making a decision.
They explained that he had already been given ample opportunity to consult with an attorney and that the opportunity had passed. Defendant has the following DWI convictions within the past ten years: 1) GM DWI in Court File ••-CR-••-•••• on 2/7/2024; 2) GM DWI in Court File ••-CR-••-•••• on 10/20/2022; 3) GM DWI in Court File ••-CR-••-•••• on 10/31/2018. Defendant was taken to the Hennepin County Jail where he remains in custody.
