There, he observed a vehicle displaying expired registration and dark tint. Even though the tabs displayed were old, Deputy Skinner determined that the registration was current. Deputy Skinner later measured the tint of the vehicle’s windows to be only 3% and non-compliant with state statute. Deputy Skinner stopped the vehicle Near Freemont Drive and Freemont Ave, still in Zimmerman. He approached the vehicle and spoke to the driver, identified as NATHANIEL CHERRY MOORE, [DOB REDACTED], the above-named defendant.
Deputy Skinner saw that the Defendant had dilated pupils, a shaky/jittery leg, and was increasingly nervous. Deputy Skinner also saw a front seat passenger that displayed signs of recent narcotics use. Deputy Skinner learned that the Defendant had a revoked driver’s license and noticed that his story about where he was coming from and going to didn’t make sense. He asked the Defendant to step out of the vehicle, and the Defendant handed the passenger his phone saying, “I’m probably going to jail.” The Defendant admitted that there was pipe in the vehicle, and that he had used narcotics in the past, although his history of use was inconsistent.
After finding the pipe, Deputy Skinner searched the vehicle. In the center console, he found a grocery bag. Inside the grocery bag, there were a bunch of shop rags, and, buried within the shop rags, was a small clear plastic baggie that contained a white crystal-like substance. Deputy Skinner recognized the substance as methamphetamine from his training and experience. The Defendant, on the side of the road, said “I will claim it” and, during a Mirandized statement, admitted to using methamphetamine two-days before the stop.
The substance was sent to a lab for testing and tested positive for methamphetamine, a Schedule II Controlled Substance. The lab determined it weighed 1.983 grams.
