That on September 14, 2025, at approximately 11:20 P.M. Robbinsdale Police officers were on routine patrol driving westbound on Lake Drive when they saw an individual later identified as Dan Charoen William Prentice and Defendant herein, driving a Tesla Model 3, Minnesota license CUTCO2, eastbound on Lake Drive near France Avenue North at a high rate of speed. The Robbinsdale officers clocked the speed of Defendant’s vehicle at 50 miles per hour in the posted 35 miles per hour speed zone. The officers made a U-turn to follow Defendant and clocked Defendant’s vehicle’s speed at 54 miles per hour in the 35 miles per hour speed zone.
The officers observed that Defendant did not come to a complete stop for the stop sign at Lake Drive and Memorial Parkway, and also did not come to a complete stop for the stop sign at 45th Avenue North and Sheridan Avenue North. Defendant then turned south into an alleyway in between Sheridan Avenue North and Russell Avenue North and parked at [ADDRESS REDACTED] North in the City of Minneapolis, Hennepin County, Minnesota. The Officers made a traffic stop. Defendant stepped from his vehicle and appeared confused.
The officers approached and advised Defendant of the basis for the traffic stop. Defendant appeared confused and did not know how fast he was going. When asked where he was coming from, Defendant stated from the Eagles Nest, which is a bar located in the City of Robbinsdale. While speaking with Defendant, the officers observed that Defendant had bloodshot and watery eyes, along with slurred speech. When asked if he had anything to drink, Defendant stated he had one shot of Fernet, which is a liqueur.
The officers also smelled the odor of an alcoholic beverage coming from Defendant as he spoke. The officers asked Defendant to submit to field sobriety tests during which they observed him to display horizontal gaze nystagmus, poor balance and did not otherwise perform tests as instructed. Defendant submitted to a PBT with the result of.138 alcohol concentration. Robbinsdale Officer M. B. Believed that Defendant was under the influence of alcohol and placed him under arrest for DWI. Defendant was transported to the Robbinsdale Police Department where he was read the breath test advisory and after being allowed time to consult with an attorney, submitted to a breath test with the result of.14 alcohol concentration at 12:43 A.M.
