On January 28, 2026, at 03:47, Shakopee Police Officers were on patrol on Hwy 169 near Eagle Creek Blvd., Shakopee, Scott County, Minnesota, when the officer saw a vehicle weaving back and forth within its lane. The officer saw the vehicle had a dealer license plate to be upside down and the vehicle continued to weave back and forth, touching the center line and the fog line. The officer stopped the vehicle. The officer identified the driver as Nicholas Rocco Wolf III, [DOB REDACTED], hereinafter the Defendant.
While speaking with the Defendant, the officer noticed he had slow movements and had trouble understanding questions. He stated he was traveling from his house and pointed at HyVee. The officer saw the Defendant had watery and glossy eyes. The officer smelled the slight odor of a consumed alcoholic beverage. When asked how much he had to drink, the Defendant stated none. The officer had the Defendant exit the vehicle. The Defendant agreed to perform field sobriety tests, which he failed. The Defendant took a preliminary breath test, which resulted in a reading of.17 BAC. The Defendant was arrested for DWI and taken to the Shakopee Police Department.
The officer read the breath test advisory to the Defendant. The Defendant initially wanted to speak with an attorney, but when provided a telephone and directories, he stated he did not know who to contact. When asked if he still wanted to speak with an attorney, he stated no. The Defendant agreed to take the DMT breath test, which resulted in a reading of.19 BAC at 04:49. The Defendant was taken to the Scott County Jail. A review of the Defendant's history showed five previous DWI convictions; none were within ten years.
