Said officers were dispatched to a domestic disturbance at [ADDRESS REDACTED] North, [APT REDACTED] in the City of Forest Lake, Washington County. Officers were advised by dispatch that there was an openline 911 call originating from the residence. The caller was not speaking directly to the operator and it sounded like it might be a child on the phone due to breathing.
A female could be heard whispering "oh God, oh God." A male was yelling and swearing, but it sounded like he might be in a different room. Later, the yelling got louder and it appeared that the male was closer to the phone. At that point, it sounded like there was a physical altercation with the female saying "please, please, please" and "stop." Officers made entry into the apartment complex, through an open ground floor window. They could hear a male screaming and yelling from inside [APT REDACTED]. Officers knocked and announced "Police," to which a male party, later identified as Anthony Perez Rivera, began screaming obscenities toward the officers.
Officer Schimmelman unholstered her Taser 10 and kept it at the low, ready position. Mr. Perez Rivera was instructed to open the door and he refused. Because it sounded like there was an ongoing domestic assault in progress, Perez Rivera was advised that the officers would force entry into the apartment unless the door was opened. A female, later identified as Ariela Perez, could then be heard inside the residence. She was advised to open the door, Mr. Perez Rivera indicated that she could not open the door.
Eventually Officer Cinelli kicked in the door and officers made contact with Mr. Perez Rivera. As Mr. Perez Rivera was being placed under arrest, Ariela Perez identified herself, but continued to appear very fearful. Ms. Perez described Anthony Perez Rivera as both her husband, and at a later time her ex-husband. The parties' four children, ages seven, six, three, and one were present in the residence. There was blood on the walls, which Ms. Perez attributed to her son having a bloody nose. Ms. Perex would not make eye contact with the officers and appeared to be very fearful.
She indicated that Mr. Perez Rivera had been drinking alcohol and had been yelling and screaming at her. She indicated that she left the room and locked herself in the bedroom with the children. She called 911 and hid her cell phone in her bra. She indicated that Mr. Perez Rivera was banging on the door and that she was fearful. According to one of the children, Mr. Perez Rivera kicked in the bedroom door. Ms. Perez described it as falling off the hinges. The officers observed that one of the bedroom doors had been knocked or kicked in off the hinges and the frame.
