02/16/2002), including motor vehicle titles and motor vehicle insurance. There was also an expired Minnesota instructor permit for CONTRERAS OCHOA laying on the air mattress. Inside the nightstand were several small plastic baggies, containing a powder-like substance that field tested positive for cocaine. An electric scale and several small empty zip-lock baggies were in the nightstand as well. The substance was later weighed and weighed 2.28 grams. At approximately 1602 hours, Detective Arredondo and Detect Jason Evans located CONTRERAS OCHOA outside of the apartment building.
Detective Arredondo was wearing his outer carrier vest that clearly displayed “Police” and a badge. CONTRERAS OCHOA looked at them and continued to walk towards the apartment. Detective Arredondo called out again, CONTRERAS OCHOA turned around and looked at them. Detective Evans signaled for CONTRERAS OCHOA to come towards them and CONTRERAS OCHOA began to run away. Detective Arredondo advised CONTRERAS OCHOA he was under arrest and needed to stop. CONTRERAS OCHOA ran through the apartment building, up to the third floor and Detective Arredondo was able to catch up and place him under arrest.
After being read his Miranda rights, CONTRERAS OCHOA agreed to speak with Detective Arredondo. When he was informed cocaine was located, CONTRERAS OCHOA denied knowing the cocaine was there and claimed he was not tall enough to reach the shelf. When asked which shelf, CONTRERAS OCHOA stated he was not sure if there was something on the shelf he put his clothes on. CONTRERAS OCHOA was informed the cocaine was found in the nightstand.
