Your complainant is Trooper Alejandro Dominguez with the Minnesota State Patrol. Your complainant states that on December 19, 2023, he was on routine patrol when receiving a driving complaint on a gold vehicle with license plate [PLATE REDACTED]. Trooper Dominguez located the vehicle Eastbound on 694 in Maple Grove, Hennepin County, Minnesota. The gold Rav 4 vehicle was driving over the left lane line and had expired registration. Trooper Dominguez initiated a traffic stop and made contact with the driver, who was identified as, KYLE MICHAEL MURPHY, [DOB REDACTED]. Trooper Dominguez detected the odor of alcohol.
MURPHY stated that it had been a couple of months since he had last drank. When asked to get out of the vehicle, MURPHY was delayed in getting out. Once he did start to get out of the vehicle, he forgot to put the vehicle in park first, causing the vehicle to roll forward. MURPHY then pressed the gas instead of the break, causing the vehicle to rev. Once out of the vehicle, MURPHY used his vehicle for support and was stumbling to walk. Trooper Dominguez had MURPHY perform field sobriety testing, which showed further clues of intoxication.
MURPHY stated that he was out for his birthday and that he had a couple of shots. Due to an issue with MURPHY’s blood sugar, he was transported to the hospital, and Trooper Dominguez applied for a search warrant of his blood or urine. The search warrant was granted by Judge Sande and MURPHY’s blood was collected. BCA testing of MURPHY’s blood came back positive with an alcohol concentration of.180.
