On January 17, 2026, at approximately 11:30 P.M., Officer Hansen of the Austin Police Department was on routine patrol driving through the parking lot of Kwik Trip located at [ADDRESS REDACTED] West in the City of Austin, County of Mower. As Hansen was driving through, he observed DEAVION KAVON THOMPSON, DOB/053105, the defendant herein, standing at the checkout line of the store. Hansen is familiar with the defendant and his prior involvement with firearms and large amounts of controlled substances.
Hansen learned the defendant’s driving privileges are revoked. Officer Hansen observed the defendant walk up to the driver’s side of a Dodge Durango(MN LIC/3DR628) that was registered to the defendant’s mother. Hansen observed the vehicle exiting the parking lot onto 12th Street SW where it began to drive southbound. As the vehicle passed by the officer, Hansen observed the defendant to be driving the vehicle. Hansen followed the defendant as it turned westbound on 2nd Avenue SW. The defendant pulled over in the 1300 block of 2nd Avenue SW prior to Hansen initiating a traffic stop.
Hansen knows from training and experience that subjects involved in criminal activity will often exit the roadway or park in an effort to avoid law enforcement. Hansen activated his emergency lights. Officer Hansen approached the vehicle and made contact with the defendant, the sole occupant of the vehicle. Immediately upon reaching the defendant’s open driver’s window, Hansen detected the overwhelming strong odor of marijuana coming from inside. Hansen informed the defendant of the reason for the stop.
The defendant stated that he was “going home” and had just been getting gas. Hansen noted that the defendant was traveling in the opposite direction of his home and the defendant responded that he saw the officer behind him and felt that he was going to be pulled over so he pulled over before a traffic stop was initiated. Officer Keesey arrived and approached the passenger side of the defendant’s vehicle. Keesey observed a clear plastic bag with a green leafy substance on the passenger floorboard.
Keesey knows from training and experience the substance to be marijuana. Keesey informed Hansen of the marijuana in the vehicle. Officer Hansen asked the defendant if he had marijuana in the vehicle. The defendant responded, “yeah I do.” Hansen asked if the marijuana was packaged properly, to which the defendant replied it was. Hansen then asked the defendant if he could see the package to confirm. The defendant then picked up a large plastic bag of marijuana flower and showed it to Hansen. Officer Hansen observed that bag to be plastic with little to no markings on it and was simply tied off on the top as opposed to being properly sealed.
