Your complainant states that on November 8, 2025, at approximately 2:27 A.M., she observed a Buick Encore bearing Minnesota license plate number RME673 that appeared to be traveling above the speed limit on Highway 169, in the City of Plymouth, Hennepin County, Minnesota. Your complainant activated her radar and received a reading of 80 miles‐per‐hour in a 60 mile‐per‐hour zone. A registration check revealed that the registered owner’s driving privileges were revoked. While following the vehicle on eastbound Bass Lake Road, your complainant observed it cross over the fog line and move from the right lane of traffic into the center lane without signaling.
Your complainant initiated a traffic stop of the vehicle, which turned onto Decatur Avenue North before coming to a stop. Your complainant approached the passenger side of the vehicle and observed that driver did not notice her at the window. After tapping on the window to get his attention, the driver, who was identified as JAMESON GLENN TATE, [DOB REDACTED], the defendant herein and registered owner, fumbled to roll down the window and reached across the passenger seat to roll it down, but then used the control on the driver’s side door.
Your complainant explained the reason for the stop to the defendant, who appeared to be avoiding eye contact. While speaking with the defendant, your complainant observed that his eyes were red, bloodshot, and watery. Officer Magy arrived at the stop location and detected the odor of an alcoholic beverage emanating from the defendant’s person. Officer Magy also observed that the defendant’s eyes were bloodshot and watery, his eyelids were droopy, and his speech was slurred. When asked, the defendant admitted consuming three or four Hamm’s beers.
The defendant was unable to successfully perform field sobriety tests as requested by Officer Magy and failed the preliminary breath test. Based upon his observations, Officer Magy formed the opinion the defendant was under the influence of alcohol, and the defendant was placed under arrest. The defendant was transported to the Plymouth Police Department, where he was read the Minnesota Breath Test Advisory. The defendant elected to submit a sample of his breath for testing, the result of which indicated his alcohol concentration to be.15 at 3:20 A.M. A check of the defendant's driving record on November 8, 2025, reveals a prior impaired driving conviction, a prior alcohol‐related license revocation, or violation of an ordinance in conformity therewith, on January 4, 2025. This check also revealed that the defendant’s driving privileges were revoked on January 4, 2025, and have not been reinstated as of November 8, 2025. The defendant was read the Miranda warning and admitted consuming four 16‐oz.
