On 01/24/26, at approximately 2252 hours, law enforcement responded to a residence in Moorhead, Clay County, MN regarding a physical domestic dispute. Dispatch relayed that a male called 911 and that a female could be heard screaming in the background. The male was identified to be LUCAS KINGDON AVALOS [DOB REDACTED], hereinafter referred to as Defendant. The female was identified to be T. D. C., hereinafter referred to as Victim. Defendant and Victim are in a dating relationship. When law enforcement arrived at the residence, they talked to the Victim [NAME REDACTED]. She appeared to be short of breath and explained that she and the Defendant had gotten into an argument that became physical.
She confronted the Defendant about turning off the internet in the apartment and the Defendant responded by grabbing her throat and throwing her to the ground. Victim explained that the Defendant used both of his hands to choke her, and while this was occurring he was spitting in her face. She also explained that at some point in the struggle the Defendant hit her in the left eye, causing her glasses to come off her face. Law enforcement noted that the Victim [NAME REDACTED] on both sides of her neck and a red mark next to her left eye.
There was also a scratch above the Victim's eyebrow consistent with her statements. Photographs were taken of her injuries. Victim explained that the Defendant choked her long enough that she nearly passed out and that she was "trying to tell him I couldn't breathe." Victim explained that it felt like she was having an asthma attack during the strangulation and that she was having trouble swallowing. Victim [NAME REDACTED] only stopped because she fought back against the Defendant by scratching him so that he would get off her.
Defendant claimed that the Victim [NAME REDACTED]. Defendant then said he responded by wrapping his hands around her neck and then "threw her onto the ground." Defendant said that he thought the Victim could still breathe while he was choking her because she was screaming. Law enforcement observed injuries to the Defendant's person that were consistent with the Victim's statement and appeared to be defensive marks from the Victim as she tried to free herself from being strangled. **This is a DV Court case for purposes of scheduling.
