Officer Schroeder handcuffed the defendant, placed him in the back of his squad car, and Officer Schroeder searched the defendant’s vehicle incident to arrest. Officer Schroeder observed two unopened cans and one empty can of Budweiser in the vehicle. Officer Schroeder transported the defendant to the Mower County Jail and read the defendant the Minnesota Breath Test Advisory. The defendant stated he understood the advisory and wanted to speak with an attorney. The defendant called one attorney, left a voice mail, and then ended his attorney time.
The defendant agreed to take a breath test, administered by Officer Schroeder, which resulted in a value of 0.20 BAC at 8:01 P.M. A review of the defendant’s criminal history shows a driving while impaired conviction dated March 3, 2025 (see Freeborn County District Court file number 24-CR-24-1360). A review of the defendant’s driver’s license record shows two revocations for driving while impaired incidents, one dated November 11, 2024 3 50-CR-26-629 Filed in District Court State of Minnesota 4/7/2026 (see Olmsted County District Court file number 55-CR-25-436) and the other dated September 9, 2025 (see Mower County District Court file number 50-CR-25-1653). A review of the defendant’s driver’s license record shows his driving privileges are also Cancelled – Inimical to Public Safety.
