M., Winona Police Department Officer ("Officer") was dispatched to the area of Street and Junction Street, in the City and County of Winona, Minnesota, regarding a physical disturbance. While dispatch was on the phone with the reporting party ("Victim") they could hear yelling and that the suspect might have a weapon. Officer responded to the area emergently. Upon arrival at the scene, Officer met with Victim. While he was speaking with victim, Officer observed Victim had a fresh and bleeding wound about 1.5 inches in length above his right eye.
Victim told Officer he had been in a friend's garage located at Maceman Street when Daniel Allen Liston ([DOB redacted]) ("Defendant") walked into the garage and confronted him. Victim stated the confrontation was over Victim's relationship with Defendant's girlfriend. Victim stated Defendant shined a spotlight in Victim's face and hit him with the spotlight an estimated ten times while making the comments, "I am going to kill you." Victim stated Defendant hit him several more times until he lost consciousness.
Victim reported he lost consciousness for about thirty seconds. Victim described the garage area as a small space about six square feet in size. Officer observed the garage and confirmed this statement to be true. Victim reported he began running to the east and Defendant chased him. Victim stated that Defendant was threatening him with bodily harm this entire time. Victim stated he feared Defendant during the incident. Victim stated he was afraid Defendant would seriously injury or kill him. Victim showed Officer a Facebook message he received from Defendant.
The message states, "You better hope you see me coming.when | catch you.you will know." This message was sent on April 6, 2026, at 12:04 P.M. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49., intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
