On about December 4, 2025, in Robbinsdale, Hennepin County, Minnesota, officers stopped a car driven by Defendant Anthony Nutzeng Vang [DOB REDACTED] because he was using his cell phone while driving and was speeding. When officers spoke with Defendant, he confirmed he did not have a valid driver's license. When officers ran their routine checks, they learned Defendant's license was cancelled DAC-IPS. When officers reapproached Defendant's car, they could smell an odor of alcohol coming from the car.
Defendant was smoking trying to cover up the alcohol smell. Officers also noticed that Defendant's speech was slurred and he was slow to respond to questions. Based on this information, officers asked Defendant to preform field sobriety tests which he agreed to do. During Defendant's performance of the field sobriety tests, officers noticed several clues of impairment. Officers next asked Defendant to perform a PBT which he agreed. Defendant's PBT sample showed a reading of.105 BAC. Based on all the information, officers placed Defendant under arrest.
After Defendant was placed under arrest, he was taken to the police department where he was read the breath test advisory. Defendant confirmed that he understood the advisory, was given a chance to talk with an attorney, and agreed to a breath test. During the Defendant's first breath test, he did not keep a tight seal around the mouthpiece and was blowing air around the mouthpiece in an attempt to manipulate the test. The test sequence timed out and was deemed a deficient sample. Officers gave Defendant a second chance at the breath test.
During Defendant's second chance at the breath test, he continued to blow around the mouthpiece and the second test timed out and it was deemed a deficient sample. Given that Defendant was given two breath tests, both of which timed out and were deemed insufficient samples, and Defendant's attempts to manipulate the tests, Defendant, through his actions, refused the breath test. Based on a review of Defendant's criminal history, he has three prior DWI convictions within the last 10 years in cases: 62SU-CR-18-383- DWI refusal; 62SU-CR-17-3168- DWI; and 62SU-CR-17-533- DWI. Defendant is currently in custody.
