All of the conduct described herein occurred within the County of St. Louis, State of Minnesota, unless otherwise noted. On October 29, 2025, Duluth Police responded to multiple calls at 114 E 3rd St throughout the day. There was a dispute over residency of the apartment and the property inside the apartment. Wesley Davon Evans [DOB REDACTED] hereinafter Defendant wanted to retrieve property from the residence, as he claimed he lived there with his girlfriend who just passed away. Officers ultimately determined Defendant established residency at the apartment and determined it was a civil issue and there was no crime being committed at the time.
At approximately 5:20 P.M., Duluth Police responded to 114 E 3rd St again for a disturbance. It was reported Defendant was breaking windows of a building throwing items out into the alley. Officers saw Defendant throwing property in the alley while screaming. There was glass, broken mirrors, and various household items all over the alley. An adult female, V. M. T. Was in the apartment and said she was there to help Defendant move things to his apartment. V. M. T. Talked to officers and said she did not really know Defendant but offered to help him move stuff and she did not expect him to act this way and was afraid to grab her things.
Defendant then started to scream at officers that two individuals needed to be charged and made some kind of comment about someone dying tonight if they don't. Defendant started screaming at V. M. T. Saying she needed to stay because she was a witness, but then started insulting her for leaving. V. M. T. Started to walk away and Defendant started speed walking towards her and accused her of stealing his things. V. M. T. Felt threatened. Officers decided to arrest Defendant for disorderly conduct due to his relentless behavior.
Defendant was standing at the rear of 118 E 3rd St, which is Defendant's apartment. As officers approached Defendant, he went into his residence. Officers tried to speak with Defendant and advised him he was under arrest. Defendant said he was not coming out and he wanted his keys back. At one point, Defendant said through the door, "If you come in, I'm going to shoot you." Officers attempted to speak with Defendant through the window and Defendant continued to make statements about getting his keys and pressing charges.
Defendant became angry again and struck the window with his hand, breaking the window. The window shattered into multiple pieces, sending flying glass everywhere, which even hit one officer. Defendant then grabbed a baseball bat from the residence and proceeded to walk around the apartment breaking out nearly every window that was observable from the exterior of the apartment. Defendant also started to smash the baseball bat into an interior door, causing damage. Defendant then smashed the baseball bat into counters, the wall, windows, and doors.
