On March 27, 2026, at approximately 2:37 P.M., Savage Police Officer Brentan Carkhuff ("Officer Carkhuff") received a report of threats from dispatch. Dispatch relayed that an adult male was threatening the reporting party and the reporting party's family, The reporting party was an adult male (fully identified in law enforcement reports and hereinafter referred to as "Victim 1"), and Victim 1 also reported that his brother, who is a vulnerable adult (fully identified in law enforcement reports and hereinafter referred to as "Victim 2") were the subject of the threats.
Based upon this information, Officer Carkhuff called Victim 1. Officer Carkhuff spoke to Victim 1 over the phone and learned the following: Victim 1 lives with his younger brother, Victim 2, who is a vulnerable adult. Victim 1 is Victim 2's caretaker. Victim 2 had met a friend several years ago that Victim 1 had also become close with. This friend was identified as Nicholas Fenton Emery Jr., [DOB REDACTED] (hereinafter "DEFENDANT"). DEFENDANT had been to Victim 1 and Victim 2's home several times and they had gone out to dinner together before.
Over the last 3 months, DEFENDANT's personality had changed and DEFENDANT had become verbally abusive. Victim 1 had asked Victim 2 not to communicate with DEFENDANT anymore as a result of safety concerns. DEFENDANT got very upset with Victim 1 for not allowing Victim 2 to communicate with him. DEFENDANT was upset and repeatedly messaging Victim 2 nonsense. Victim 2 had shown Victim 1 a message which said DEFENDANT was going to come to their house and shoot Victim 2. DEFENDANT also had messaged Victim 2 that he was going to go to their house and burn it down.
In addition to this information, Victim 1 showed text messages that he had personally received from DEFENDANT. One message read, "I'm heading down to the courthouse right now and putting an ROR on your retarded piece of shit brother [Victim 2]. Before I beat the living shit out of him." In another text DEFENDANT wrote, "Ill [sic] show you who's goof. When I beat yours and [Victim 2's] faces into the concrete. If I every [sic] see drive or walk pass my building ever again." Officer Carkhuff observed that these messages were dated March 9, 2026, on Victim 1's phone.
Based upon this information, Officer Carkhuff spoke with Victim 2. Victim 2 relayed the following: DEFENDANT got pulled over and arrested a few weeks prior. DEFENDANT blamed Victim 2 because he was driving to his home. DEFENDANT then stated that if he ever saw Victim 2 walking near his apartment, he would run up and stab Victim 2. DEFENDANT then apologized and regained Victim2's trust. Victim 2 then received a message that DEFENDANT was going to come to Victim 1 and Victim 2's house and burn their house down.
Victim 2 said that the message was then deleted by DEFENDANT. Victim 2 said that DEFENDANT was bullying him and that DEFENDANT likes making people fearful of him. 2 70-CR-26-4861 Filed in District Court State of Minnesota 3/30/2026 Victim 2 then showed Officer Carkhuff a message threat wherein DEFENDANT wrote, in relevant part, the following to Victim 2: "I'll come over with a glock 45 and put you and [Victim 1] out of your misery. Will I, no karma is a bitch. Plus though I don't like [Victim 1]. Actually, you are a n***** [obscenity omitted]. Since you just constantly sit on your ass in a house that you claim that treat you like shit and game." Based on these threats, Officer Carkhuff asked Victim 2 if he believed DEFENDANT did in fact have a firearm.
